These Terms of Service ("Terms") govern your access to and use of our automated trading bot platform, website, and related services (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.
Important: Trading cryptocurrency involves substantial risk of loss. Automated trading bots can amplify both gains and losses. You should only trade with funds you can afford to lose. Please read our Risk Disclosure carefully.
1. Eligibility
To use Fomoed, you must:
Be at least 18 years of age
Have the legal capacity to enter into binding agreements
Not be prohibited from using the Service under applicable laws
Not be located in a jurisdiction where cryptocurrency trading is prohibited
Have a valid account with at least one supported exchange
2. Account Registration
When creating an account, you agree to:
Provide accurate and complete information
Maintain the security of your account credentials
Immediately notify us of any unauthorized access
Accept responsibility for all activities under your account
3. Exchange API Access
API Key Requirements
To use our trading bots, you must provide valid API credentials from supported exchanges. You agree that:
You will only provide API keys with trading permissions (not withdrawal permissions)
You are the rightful owner of the exchange account
You comply with the terms of service of your chosen exchange(s)
You can revoke API access at any time through your exchange
Supported Exchanges
We currently support: Hyperliquid, AsterDEX, GRVT, Extended, Decibel, and StandX. Exchange availability may change without notice.
Custody of your funds (all funds remain on your exchange)
Insurance against trading losses
5. Fees and Payments
DEX Trading (Free Tier)
Trading on decentralized exchanges (Hyperliquid, GRVT, AsterDEX) is free. A small builder fee (0.01%) is applied to trades, which is standard for DEX trading.
Builder Code Fees
All trading on supported exchanges uses a builder code fee model. A small fee (currently 0.01%) is applied per trade. Fee rates are subject to change with notice.
Payment Terms
All fees are quoted in USD
We accept cryptocurrency payments
Subscriptions auto-renew unless cancelled
Prices may change with 30 days notice
6. Prohibited Activities
You agree not to:
Use the Service for market manipulation or illegal trading activities
Attempt to reverse engineer, decompile, or hack the Service
Share your account or API credentials with third parties
Use the Service to launder money or finance terrorism
Overwhelm our systems with excessive API requests
Circumvent any access restrictions or security measures
Resell or redistribute the Service without authorization
7. Intellectual Property
All content, features, and functionality of the Service are owned by Fomoed and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary trading algorithms, software, or content.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
Uninterrupted or error-free operation
Accuracy of trading signals or strategies
Specific trading results or profits
Compatibility with all exchanges or market conditions
9. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any trading losses, regardless of cause
We are not liable for exchange downtime, API failures, or market volatility
We are not liable for unauthorized access resulting from your negligence
Our total liability shall not exceed the fees you paid in the past 12 months
10. Indemnification
You agree to indemnify and hold harmless Fomoed, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Service Modifications
We reserve the right to:
Modify, suspend, or discontinue any part of the Service
Update supported exchanges and strategies
Change pricing with reasonable notice
Terminate accounts that violate these Terms
12. Termination
You may close your account at any time. We may terminate or suspend your account immediately for:
Violation of these Terms
Suspected fraudulent or illegal activity
Non-payment of fees
At our sole discretion with notice
Upon termination, all running bots will be stopped and your API credentials will be deleted.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration.
14. Changes to Terms
We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or platform notification.
